You’ve been wronged. It’s highly emotional. For some people, an immediate reaction is to consider filing suit. Suing will get your money or your property back. Suing will get the justice you deserve.

After all, no one should be able to take advantage of another person and get away with it.

It is easy to understand the feeling of being duped or wronged. Any judge will clearly see what has happened and rule in your favor right? Take it from a litigator getting involved in a lawsuit is not always the answer.  Lawsuits are expensive, time-consuming, lengthy and unpredictable. Good news is, there are other ways to resolve problems.

WHY YOU WOULDN’T FILE SUIT

Trials are expensive and risky, taking their toll both emotionally and financially. Trials put you at the mercy of a judicial system and a judge, who may very well have opinions, viewpoints, and values different from your own.  While a trial may be a suitable alternative to never-ending, unreasonable and antagonistic interactions, a trial does not always end the case. Multiple appeals may be necessary, adding to your vast legal fees and expenses.

So, how do you know if the trial is right for you, and what are the alternatives if you do not go to trial?

What else can you do?

There are several alternatives besides litigation to settle a dispute. In some cases, these alternate means of resolution may be cheaper and faster. Additionally, the control can be placed in your hands, instead of a judge or jury.

Mediate: You could mediate. The Los Angeles Department of Consumer and Business Affairs offers a free mediation service for certain types of disputes.

Arbitrate: You could arbitrate. There are multiple services offered by various agencies. The Los Angeles City Attorney offers a dispute resolution program. Free or low-cost conflict resolution is provided by The Center for Civic Mediation, the Center for Conflict Resolution, the Los Angeles City Attorney, and the Loyola Law School Center for Conflict Resolution, which means you don’t have to invoke the legal system.
