Client was initially offered 30 days in county jail with a plea to an aggravated charge. After we got in on the case, we secured a non-jail offer to a lesser charge of simple battery.
Client crashed his automobile, injuring himself and two others. He was arrested for driving under the influence and tested positive for alcohol. We were able to convince the DA’s office that he was not under the influence at the time of driving.
Judge indicated to client that he faced mandatory jail time; we were able to secure a no jail-time probation violation.
Client pled to his 3rd DUI. Instead of the statutory minimum of 120 days in county jail, we secured a settlement to a second-time DUI instead. Client served only 3 days.
